Fedwire vs. ACH: Getting Them Out Faster in 2026

Once a bond is posted through the CeBONDS portal, the speed of your loved one's release depends entirely on the payment rail you choose. At Santamaria Law Firm, we have seen that the wrong banking choice can keep someone detained for several unnecessary days.

The 2026 Red Flag: The 3:00 PM Cutoff

ICE field offices and detention centers follow a strict daily processing window. Under current ERO (Enforcement and Removal Operations) protocols, bond posting hours are 9:00 AM – 3:00 PM in the detention center’s local time zone.

  • The Overnight Risk: If your payment is not confirmed and processed by the facility before the 3:00 PM cutoff, the release order will not trigger until the following business day. If this happens on a Friday, your loved one could remain in custody for the entire weekend.

Why We Recommend Fedwire:

While the CeBONDS portal technically allows for Automated Clearing House (ACH) transfers, using them is a major risk:

  1. Settlement Speed: ACH transfers typically take 3 to 5 business days to clear. Under 8 C.F.R. § 103.6, ICE will not authorize a release until the funds are fully settled in the government's account.

  2. Fedwire (The Gold Standard): Fedwire is a real-time, high-speed electronic funds transfer system. When initiated before your bank’s cutoff, it usually settles within minutes or hours, ensuring the bond is verified the same day.

  3. Statutory Minimums: Remember that under Matter of Castillo-Padilla, 25 I&N Dec. 257, the statutory minimum for a bond is $1,500. Regardless of the amount, the speed of release is governed by the speed of the money.

Why Professional Oversight Matters: At Santamaria Law Firm, we coordinate directly with our clients to ensure Fedwire instructions are formatted correctly. A single typo in the reference field can cause a Manual Review flag, missing the 3:00 PM deadline.
