The U visa is a nonimmigrant option available to non-citizens that have been victims of serious crimes. The policy of this visa is to help law enforcement agencies investigate and prosecute criminals and protect victims of such crimes.
Who is eligible for the U Visa?
There are six eligibility requirements for U visa status:
The applicant is a victim of a qualifying criminal activity;
The applicant has suffered substantial physical or mental abuse as a result of having been a victim of criminal activity;
The applicant has information about the criminal activity;
The applicant has obtained certification from federal, state, or local law enforcement authority verifying her helpfulness in the investigation or prosecution of the criminal activity;
The applicant must be admissible to the Unites States; and
The criminal violated the laws of the United States or the criminal activity occurred in the United States.
If the applicant satisfies these requirements, then if approved by USCIS, then applicant can eventually obtain a work permit (employment authorization) and possible path to citizenship. Please consult with an immigration attorney if you have further questions.
