What is Naturalization & Citizenship (Form N-400)?

Naturalization is the legal process through which an eligible foreign-born individual voluntarily becomes a United States citizen after birth. For most lawful permanent residents (Green Card holders), the process involves filing Form N-400, Application for Naturalization, with U.S. Citizenship and Immigration Services (USCIS), establishing statutory eligibility, completing the required examination, and taking the Oath of Allegiance. Naturalization is governed primarily by the Immigration and Nationality Act (INA § 310 et seq.) and applicable federal regulations under 8 C.F.R. Part 316.

Statutory Eligibility Criteria

Under INA § 316(a) and 8 C.F.R. § 316.2, most applicants must satisfy the following fundamental legal requirements:

  • Age Requirement: Must be at least 18 years old at the time of filing Form N-400.

  • Continuous Residence & Physical Presence: Must have held lawful permanent resident status for at least five (5) years and been physically present in the United States for at least 30 months during that period, without extended absences exceeding 180 days that break continuous residence under 8 C.F.R. § 316.5.

  • Three-Year Provision for Spouses of U.S. Citizens: Under INA § 319(a), spouses who have been married to and living in marital union with a U.S. citizen for at least three (3) years may qualify for naturalization after holding a Green Card for only three years and demonstrating at least 18 months of physical presence.

  • Jurisdictional Residence: Must reside for at least three (3) months in the state or USCIS district having jurisdiction over the applicant's place of residence.

  • Good Moral Character (GMC): Must demonstrate Good Moral Character under INA § 101(f) and USCIS Policy Manual (Vol. 12, Part F) during the statutory period and up to the Oath of Allegiance.

  • English Language & U.S. Civics Mastery: Must demonstrate an understanding of the English language (reading, writing, and speaking) and pass a U.S. history and government (civics) examination under INA § 312(a), unless a statutory exception or medical accommodation applies.

Overcoming Complex Naturalization Challenges & Medical Waivers

While standard naturalization cases proceed smoothly, complex immigration or personal histories require aggressive legal intervention prior to filing Form N-400:

  • Handling Criminal History & Convictions: Prior arrests, citations, DUI convictions, or petty offenses can trigger Good Moral Character (GMC) red flags or even place a permanent resident into removal proceedings under INA § 237(a)(2). We conduct exhaustive criminal record audits, review court dispositions, and prepare comprehensive legal briefs demonstrating rehabilitated moral character.

  • Form N-648 Medical Disability Exceptions: Under INA § 312(b)(1) and 8 C.F.R. § 312.2(b), applicants who cannot fulfill the English or civics requirements due to a physical, developmental, or mental impairment (e.g., severe depression, PTSD, dementia, stroke, or traumatic brain injury) may request a full exemption using Form N-648. We collaborate directly with physicians and psychologists to ensure medical evaluations meet strict USCIS evidentiary standards.

  • Age & Long-Term Resident English Exemptions: We help senior permanent residents qualify for statutory English language test exemptions while taking the civics exam in their native language:

    - 50/20 Exemption: Age 50 or older with at least 20 years of lawful permanent residence.

    - 55/15 Exemption: Age 55 or older with at least 15 years of lawful permanent residence.

    - 65/20 Special Civics Consideration: Age 65 or older with at least 20 years of permanent residence (takes a simplified 20-question civics list).

  • Continuous Residence Interruptions & Tax Issues: We analyze extended international trips (over 180 days), tax filing compliance (Form 1040 records), and selective service registration to clear obstacles before USCIS interview scheduling.
